REALISTIC PRODUCTIONS LLC
SERVICE AGREEMENT
By accepting these terms you agree to the following terms & conditions.
    FOR, AND IN CONSIDERATION OF, the premises and the mutual covenants contained herein, You and Realistic Productions LLC do hereby agree as follows:
Advertised delivery times are based on when you have paid for the service, all funds have cleared with your bank, financial institution, or credit card company, & you have sent ALL files pertaining to the song.

1. You hereby engages the services of the Realistic Productions LLC to mix and/or master one songs for you based on the amount of songs your purchased to be mixed &/or mastered. Realistic Productions LLC hereby agrees to mix &/or master the song to the best of their ability.
2. Mixing will include Realistic Productions LLC adjusting levels, using EQ, compressors, & other dynamic based effects, reverbs, delays, & other time based effects, and various audio & software effects.
3. You understand that the mix does not include recording or re-recording services. You understands the recording and/or re-recording service is a separate fee.
4. You understand that the mix does not include editing services. Editing is an additional charge. Drum editing is $30 extra per one (1) minute of audio. Pitch correction is $30 extra per track. Editing is any adjustment or correction to timing & pitch on any instrument or vocal.
5. The Client agrees that Realistic Productions LLC will receive credit for his role as a mixing engineer for the song. The credit will be listed as Mixed & Mastered by: Eric “Realistic” Michael. The client will credit the engineer on any physical & digital release of the audio on all platforms.
6. You understand that songs exceeding 5 minutes in total length will cost an additional $40 per extra minute per song. Seconds will be rounded to the nearest minute. I.E :00-:29 will be rounded down. 0:30-0:59 will be rounded up.
7. You agree to pay Realistic Productions LLC upfront for their work on the song. Mixing will not start until payment has been received in full & all received funds have cleared. You understand the fee is non-refundable even if you are unsatisfied with the final version of the mix.
8. For “Basic Mixes” the following applies:

1. Realistic Productions LLC will deliver to the client one (1) fully mixed digital stereo audio track in .WAV & .MP3 format to the best of the Realistic Productions LLC’s abilities of each of the following versions of the song: full song mix & master.
2. You understand that the following versions are not included in the service: instrumental, A cappella, TV mix (a TV mix - or a performance mix as it is sometimes referred to as - is defined as a song that includes all tracks except the lead vocals. I.E. instruments, background vocals, harmonies.) These versions are sold separately & you can purchase these as a bundle for additional $10.00.
3. You agree to a limit of one (1) free revisions of the final mix by Realistic Productions LLC . If you would like additional revisions, there will be a $25.00 per hour surcharge for each of the additional revision. You understand re-recording of any of the song’s material after the engineer completes the first mix is not considered a revision. Re-recording is considered to be a new song & the client will have to pay for a new mix if they would like the re-recorded song mixed. A revision will be defined as a list of changes & adjustments the client wishes to have after receiving the first mix from the engineer. The engineer will then make the changes & adjustment from you list and send back a new version of the mix.
4. The mix only includes stereo mixes and does not include versions of the mixed or mastered stems and/or multitracks. You can request the mixed stems at the rate of $2.00 per stems & the mastered stems at the rate of $5.00 per stem.
5. You understand that the mix is limited to 15 tracks (or stems as they’re sometimes referred to as.) If your song exceeds this limit, you understand & agree that there will be an additional charge of $2.00 per additional track (stem) that you need mixed for this song. If you have not purchased additional tracks (stems) at checkout & refuse to purchase them before the mix has started, you acknowledge that you will not be refunded your money & Realistic Productions LLC will choose which tracks (stems) are mixed.

1. For “Advanced Mixes” the following applies:
   1. Realistic Productions LLC will deliver to the client one (1) fully mixed digital stereo audio track in .WAV & .MP3 format to the best of the Realistic Productions LLC’s abilities of each of the following versions of the song: full song, instrumental, A cappella, TV mix (A TV mix - a performance mix as it is sometimes referred to as - is defined as a song that includes all tracks except the lead vocals. I.E. instruments, background vocals, harmonies.)
   2. You understand that radio edits (censored versions) are not included in the mixing fee & are sold separately & you can purchase this version for an additional $25.00.
   3. You agree to a limit of two (2) free revisions of the final mix by Realistic Productions LLC . If you would like additional revisions, there will be a $25.00 for each of the additional revisions. You understand re-recording any of the song’s material after Realistic Productions LLC completes the first mix is not considered a revision. Re-recording is considered to be a new song & the client will have to pay for a new mix if you would like the re-recorded song mixed. A revision will be defined as a list of changes & adjustments the client wishes to have after receiving the first mix from the engineer. The engineer will then make the changes & adjustment from you list and send back a new version of the mix.
   4. You understand that the mix is limited to 40 tracks (or stems as they’re sometimes referred to as.) If your song exceeds this limit, you understand & agree that there will be an additional charge of $2.00 per additional track (stem) that you need mixed for this song. If you have not purchased additional tracks (stems) at checkout & refuse to purchase them before the mix has started, you acknowledge that you will not be refunded your money & Realistic Productions LLC will choose which tracks (stems) are mixed.
   5. The mix only includes stereo mixes and mixed versions of the stems and/or multitracks. Mastered stems are not included in this mixing service. You can request the mastered stems at the rate of $5.00 per stem.
2. For “Premium Mixes” the following applies:
   1. Up to 10 tracks of Background/harmony/doubled vocal line ups are included in this service. You can purchase additional vocal time alignment for $15.00 per additional track.
   2. Realistic Productions LLC will deliver to the client one (1) fully mixed digital stereo audio track in .WAV & .MP3 format to the best of the Realistic Productions LLC’s abilities of each of the following versions of the song: full song, instrumental, A cappella, TV mix (A TV mix - a performance mix as it is sometimes referred to as - is defined as a song that includes all tracks except the lead vocals. I.E. instruments, background vocals, harmonies.)
   3. One (1) radio edit (censored versions) is included with 1 (one) free revision for the censored version. Additional censored revisions can be purchased for $15.00 per revision list.
   4. You agree to a limit of five (5) free revisions of the final mix by Realistic Productions LLC . If you would like additional revisions, there will be a $25.00 fee for each additional revision lists. You understand re-recording any of the song’s material after Realistic Productions LLC completes the first mix is not considered a revision. Re-recording is considered to be a new song & you will have to pay for a new mix if you would like the re-recorded song mixed.
      A revision will be defined as a list of changes & adjustments the client wishes to have after receiving the first mix from the engineer. The engineer will then make the changes & adjustment from you list and send back a new version of the mix.
   5. You understand that the mix is limited to 100 tracks (or stems as they’re sometimes referred to as.) If your song exceeds this limit, you understand & agree that there will be an additional charge of $2.00 per additional track (stem) that you need mixed for this song. If you have not purchased additional tracks (stems) at checkout & refuse to purchase them before the mix has started, you acknowledge that you will not be refunded your money & Realistic Productions LLC will choose which tracks (stems) are mixed.
   6. The mix only includes stereo mixes as well as the mixed stems and mastered stems.

 

1. For the “Basic Beat Mix” service the following appiles:
   1. Realistic Productions LLC will deliver to the client one (1) fully mixed digital stereo audio track in .WAV & .MP3 format to the best of the Realistic Productions LLC’s abilities
   2. You understand that the mix is limited to 30 tracks (or stems as they’re sometimes referred to as.) If your song exceeds this limit, you understand & agree that there will be an additional charge of $2.00 per additional track (stem) that you need mixed for this song. If you have not purchased additional tracks (stems) at checkout & refuse to purchase them before the mix has started, you acknowledge that you will not be refunded your money & Realistic Productions LLC will choose which tracks (stems) are mixed.
   3. You understand that vocal mixing is not included in the beat mixing service & you will have to upgrade to a full song mix if you would like your vocals mixed.
   4. The mix only includes stereo mixes and mixed versions of the stems and/or multitracks. Mastered stems are not included in this mixing service. To receive the mastered stems, you can upgrade to an advance beat mix for an additional $25
   5. You agree to a limit of two (2) free revisions of the final mix by Realistic Productions LLC . If you would like additional revisions, there will be a $25.00 for each of the additional revisions. You understand re-recording any of the song’s material after Realistic Productions LLC completes the first mix is not considered a revision. Re-recording is considered to be a new song & the client will have to pay for a new mix if you would like the re-recorded song mixed. A revision will be defined as a list of changes & adjustments the client wishes to have after receiving the first mix from the engineer. The engineer will then make the changes & adjustment from you list and send back a new version of the mix.
2. or the “Basic Beat Mix” service the following appiles:
   1. Realistic Productions LLC will deliver to the client one (1) fully mixed digital stereo audio track in .WAV & .MP3 format to the best of the Realistic Productions LLC’s abilities

If you have not purchased additional tracks (stems) at checkout & refuse to purchase them before the mix has started, you acknowledge that you will not be refunded your money & Realistic Productions LLC will choose which tracks (stems) are mixed.
   3. You understand that vocal mixing is not included in the beat mixing service & you will have to upgrade to a full song mix if you would like your vocals mixed.
   4. The mix only includes stereo mixes and mixed versions of the stems and/or multitracks. Mastered stems are not included in this mixing service. To receive the mastered stems, you can upgrade to an advance beat mix for an additional $25
   5. You agree to a limit of two (2) free revisions of the final mix by Realistic Productions LLC . If you would like additional revisions, there will be a $25.00 for each of the additional revisions. The engineer will then make the changes & adjustment from you list and send back a new version of the mix.
3. For the “Advanced Beat Mix” service the following appiles:
   1. Realistic Productions LLC will deliver to the client one (1) fully mixed digital stereo audio track in .WAV & .MP3 format to the best of the Realistic Productions LLC’s abilities
   2. You understand that the mix is limited to 45 tracks (or stems as they’re sometimes referred to as.) If your song exceeds this limit, you understand & agree that there will be an additional charge of $2.00 per additional track (stem) that you need mixed for this song. If you have not purchased additional tracks (stems) at checkout & refuse to purchase them before the mix has started, you acknowledge that you will not be refunded your money & Realistic Productions LLC will choose which tracks (stems) are mixed.
   3. You understand that vocal mixing is not included in the beat mixing service & you will have to upgrade to a full song mix if you would like your vocals mixed.
   4. The mix includes stereo mixes as well as mixed & mastered versions of the stems and/or multitracks.
   5. You agree to a limit of three (3) free revisions of the final mix by Realistic Productions LLC . If you would like additional revisions, there will be a $25.00 for each of the additional revisions. You understand re-recording any of the song’s material after Realistic Productions LLC completes the first mix is not considered a revision. Re-recording is considered to be a new song & the client will have to pay for a new mix if you would like the re-recorded song mixed. A revision will be defined as a list of changes & adjustments the client wishes to have after receiving the first mix from the engineer. The engineer will then make the changes & adjustment from you list and send back a new version of the mix.

 

1. For the “Mastering Service” the following applies:

1. Mastering will include Realistic Productions LLC using EQ, compressors, & other dynamic based effects, various audio/software effects, & adjusting the overall volume.
2. You understand that the mastering does not include recording or re-recording services. You understand that recording and/or re-recording service is a separate fee.
3. You understands that the mastering does not include mixing or editing services.
4. You understand that the mastering is for one (1) stereo track only. Mastered stems, bus sums, multitracks, & individual session tracks are not included in the mastering.
5. You agree that Realistic Productions LLC will receive credit for his role as a mastering engineer for the song. The credit will be listed as Mastered by: Eric “Realistic” Michael. You will credit Realistic Productions LLC on any physical & digital release of the audio on all platforms.
6. Realistic Productions LLC will deliver to the client one (1) fully mixed digital stereo audio track in .WAV & .MP3 format to the best of the Realistic Productions LLC’s abilities of each of the following versions of the song: full song mix & master.
7. You may submit versions of the following to be mastered as well: instrumental, A cappella, TV mix (a TV mix - or a performance mix as it is sometimes referred to as - is defined as a song that includes all tracks except the lead vocals. I.E. instruments, background vocals, harmonies), & a radio edit that you have made yourself. These versions must be the same song that has been submitted for mastering.
8. You understand that Realistic Productions LLC radio will not be providing the radio edits (censored versions) service & that the radio edit service is sold separately & you can purchase this version for an additional $25.00
9. The master only includes a stereo master and does not include versions of the mastered stems and/or multitracks. You can submit your mix stems to be mastered & purchase the stems to be mastered at the rate of $5.00 per stem.
10. The master is considered done when the first two free revision lists are fulfilled. You can purchase additional revisions at $10.00 per list & the lists are considered done when the engineer has completed the list to the best of his abilities.
11. You agree to a limit of two (2) free revisions of the final mix by Realistic Productions LLC . If you would like additional revisions, there will be an additional charge of $10.00 for each of the additional revisions. You understand re-recording of any of the song’s material after Realistic Productions LLC completes the first 1 mix is not considered a revision. Re-recording is considered to be a new song & the client will have to pay for a new mix if they would like the re-recorded song mixed.

A revision will be defined as a list of changes & adjustments the client wishes to have after receiving the first mix from the engineer. The engineer will then make the changes & adjustment from you list and send back a new version of the mix.

1. For the “Background/harmony vocal timing alignment” service the following applies:
   1. Realistic Productions LLC will line up the timing of the background vocals & harmonies with the lead vocal to the best of his abilities.
   2. You agree to a limit of one (1) free revision. If you would like additional revisions, they can be purchased for $5.00 per revision.
2. For the “Radio Edit” service the following applies:
   1. Realistic Productions LLC will remove & or edit out curse words & inappropriate content from your submitted song.
   2. You agree to a limit of one (1) free revision. Additional revisions can be purchased for $10 per revision.
   3. The radio edit service only includes stereo mixes and does not include versions of the mixed or mastered stems and/or multitracks. You can request the mixed stems at the rate of $2.00 per stems & the mastered stems at the rate of $5.00 per stem.
3. For the “Pitch Correction” service the following applies:
   1. Realistic Productions LLC will correct the sung pitches to the best of their abilities.
   2. You agree to a limit of one (1) free revision. Additional revisions can be purchased for $10 per revision.
   3. The pitch correction service only includes stereo mixes and does not include versions of the mixed or mastered stems and/or multitracks. You can request the mixed stems at the rate of $2.00 per stems & the mastered stems at the rate of $5.00 per stem.
4. Mixing services are "work for hire" Realistic Productions LLC has no claim in either the compositional or sound recording copyright, unless set out in another agreement.
5. You are hiring Realistic Productions LLC for a “work for hire” only. Realistic Productions LLC is only to mix the agreed upon song. Realistic Productions LLC is not obligated to mix past or future songs for you. You understand the mix only includes mixing of the current version of the song. If you re-record any part of the song, Realistic Productions LLC is not obligated to mix the new recordings; new recordings do not fall under the revision definition. Any new recordings would be considered a brand new mix & you will have to pay the full mixing fee if you wish for the new recordings to be mixed.
6. Realistic Productions LLC has the right to attend and/or review the mastering of the mixes
7. You agree that the engineer will be mixing without you attending sessions & it will be additional upfront fee of $45.00 per hour if you would like to attend any of the mixing or mastering sessions.
8. The mix is considered done when the first five free revision lists are fulfilled. You can purchase additional revisions at $25.00 per list & the lists are considered done when the engineer has completed the list to the best of his abilities.
9. You understand that “bundle deals” need to be purchased at time of checkout & can not be added on later. I.E. you can not get this song mixed & then add it to a bundle discount at a later time.
10. You are acknowledging that you are the legal card holder for the payment you are using for this service or you have attained permission from the cardholder to purchase this service. If you are using a stolen payment method you agree that you are responsible for covering any money that is taken from Realistic Productions LLC due to any disputes & claims from the card holder submitting unauthorized transaction claims to their bank, financial institution, or credit card company. You also agree to cover all chargeback fees that may be applied due to these claims & processing.
11. You acknowledge that you are paying for a service & after the service has been provided you agree that you will not submit claims of “unauthorized transactions” to your bank, financial institution, or credit card company or the payment you provided for this service.
12. Realistic Productions LLC has the right to display the completed mixes on realisticproductions.net & various social media platforms for the purposes of showing demos reels & examples of the engineer’s services; however, Realistic Productions LLC does not have the right to distribute or sell the song on any platform.
13. You understand Realistic Productions LLC is not responsible for archiving songs and mixes once the hired work has been completed. You understand that you are responsible for all backups and archives once the service has been completed.
14. You understands that mixing prices may vary between customers based on total number of individual tracks within a single session and total length of individual song.

This agreement has been entered in, and is to be interpreted in accordance with the laws of, the State of Minnesota. All actions or proceeding seeking the interpretation and/or enforcement of this agreement shall be brought only in the State or Federal Courts located in Ramsey County. All parties hereby submitting themselves to the jurisdiction of such courts for such purpose. If any legal action is taken, the loser of the hearing and/or trial will pay for all legal fees for both parties.

This agreement shall be binding upon, and inure to the benefit of, the successors, assigns, heirs and personal representatives of engineer and client.

This agreement replaces and succeeds any and all prior negotiations, understandings, and agreements between the parties hereto, with respect to subject matter hereof.
This agreement may not be altered without the expressed written consent of all parties involved.

    The signatures below confirm all parties involved understand this Agreement in full and feel it is fair and just.

By accepting these terms & conditions you agree to all above statements in this agreement.

Realistic Productions Terms of Service and Privacy Policy

1. Terms

By accessing the website at http://www.realisticproductions.net, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

2. Use License

2. Further, Realistic Productions does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

4. Limitations

In no event shall Realistic Productions or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Realistic Productions's website, even if Realistic Productions or a Realistic Productions authorized representative has been notified orally or in writing of the possibility of such damage. Realistic Productions has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Realistic Productions of the site. Use of any such linked website is at the user's own risk.

7. Modifications

Realistic Productions may revise these terms of service for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service.

8. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of WI and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
